By using Crewful, you agree to these Terms of Service. If you don't
agree, don't use the app. You must be at least 18 years old and able to
enter a binding contract in your jurisdiction to use Crewful.
Crewful is a marketplace that connects customers who need a job done with
independent professionals who submit estimates on and complete that job.
Crewful is not the employer of any professional on the platform.
Professionals are independent contractors, not Crewful employees or
agents. Beyond the core post-a-job/submit-an-estimate flow, Crewful offers
a few other ways for customers and professionals to connect, all governed
by these same Terms:
on the customer map, visible to any customer browsing nearby — not just
customers they've already been awarded a job by.
availability announcement (e.g. "free this weekend") visible to nearby
customers.
professionals on a given job until that job is awarded.

clearly state that Crewful does not currently vet, background-check, or
verify the professionals on its platform, and that customers use the
service at their own risk. Do not imply vetting has occurred if it hasn't
— that's a real legal exposure. Update this section the moment background
checks are added.]

Because the professional is paid out essentially instantly once a customer
pays, there is generally no window to dispute a job before payout has
already gone out. If work was not completed as agreed, we still want to
know — a customer may report an issue at any time, and Crewful (acting as
administrator) will investigate. In the rare case a dispute is filed
before payout has actually gone out (for example, a brief delay while a
failed payout is automatically retried), the payout is frozen pending
review and Crewful resolves it by either releasing the payment to the
professional or refunding the customer. Once payout has been released, a
formal dispute can no longer be filed through the app; Crewful may still
investigate a report and issue a refund at its discretion, but this is not
guaranteed. Customers should raise concerns before paying whenever
possible. A job can only have one open dispute at a time. Filing a dispute
in bad faith, or to avoid paying for legitimately completed work, is
prohibited conduct under Section 8 and may result in account termination.
If you register as a professional, you represent that you have any
required licenses, permits, or insurance for the work you offer, and that
the information in your profile (bio, categories, insurance status,
licensing status, years of experience, references) is accurate. If you
are not formally licensed for a trade that customarily requires one, you
must say so in your profile rather than leaving it blank or implying
otherwise. Misrepresenting your qualifications, licensing, or insurance
status may result in account termination and, where applicable, legal
liability. If you enable Storefront or post to the Board, you're
responsible for keeping that content accurate and current in the same way
as the rest of your profile.
You agree to provide accurate job details and safe access for a
professional to complete agreed-upon work, and to pay the agreed price
through the app rather than attempting to circumvent Crewful's payment
system. Posting a job anonymously does not exempt you from these
responsibilities — your identity is still known to Crewful and is
disclosed to the awarded professional once a job is awarded.
You agree not to: solicit or complete payment for a Crewful job outside
the app to avoid platform fees; submit fraudulent estimates or reviews; harass
another user; misrepresent your identity, licensing, or insurance; or use
the app for any unlawful purpose.
**Crewful has zero tolerance for objectionable content or abusive
behavior.** This includes anything posted in job descriptions, estimates,
Board posts, messages, reviews, or profiles that is threatening, harassing,
hateful, sexually explicit, or otherwise abusive. Use the in-app Report
option on any user, message, or review to flag content or behavior that
violates this policy, and the in-app Block option to immediately stop
a user from contacting you or submitting estimates on your jobs. Our team
reviews every report and may suspend or permanently remove any account
that violates this policy, with or without prior notice.
Cade Corlew does not provide insurance coverage for work
performed by professionals on the platform. [This section needs input from
an insurance broker familiar with marketplace/gig platforms — see the
launch checklist item — to correctly state what liability, if any,
Crewful carries versus the individual professional.]
Crewful is provided "as is" and "as available," without warranty of any
kind. We do not guarantee the quality, safety, or legality of work
performed by professionals, the accuracy of any profile, estimate, review,
Storefront listing, or Board post, or that the service will be
uninterrupted, error-free, or secure. To the fullest extent permitted by
law, we disclaim all warranties, express or implied, including
merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Cade Corlew is not
liable for any indirect, incidental, or consequential damages arising from
work performed by a professional, property damage, personal injury, or
payment disputes between users. [This is the single most important section
for a lawyer to size correctly given Crewful's marketplace model —
consult one before launch, not after.]

on it.] You agree to indemnify and hold Crewful and Cade Corlew harmless
from any claim, damage, or expense (including reasonable legal fees)
arising from: your use of the app, the work you perform or have performed
through the app, your violation of these Terms, or your violation of any
law or third party's rights. This does not require you to indemnify
Crewful for Crewful's own negligence or willful misconduct.

added yet. Many marketplace platforms use binding arbitration with a
class-action waiver here, but that's a real strategic and legal decision
(enforceability varies by state, and some states restrict it in
employment-adjacent contexts) — don't add one without a lawyer's input
on whether it fits Crewful's situation.]
We may suspend or terminate your account for violating these terms,
including fraudulent estimates, payment circumvention, or safety violations.
We may update these Terms as Crewful's features change. We'll update the
"Last updated" date above when that happens, and will notify users of
material changes through the app. Continuing to use Crewful after a
change takes effect means you accept the updated terms.
You may not assign or transfer your rights under these Terms without our
consent. We may assign these Terms in connection with a merger,
acquisition, or sale of assets, or by operation of law.
If any provision of these Terms is found unenforceable by a court, that
provision will be limited or removed to the minimum extent necessary, and
the remaining provisions will stay in full effect.
These Terms, together with the Privacy Policy, are the entire agreement
between you and Crewful regarding your use of the app, and supersede any
prior agreements on the same subject.
These terms are governed by the laws of Tennessee, without regard to
conflict-of-law principles. [Marketplace facilitator and money-transmission
rules vary by state — confirm this section with a lawyer per the launch
checklist's business/legal item.]
